Issue:

Revised Board Bylaw 9250 and new Exhibit 9250.

Superintendent's Recommendation:

Approve revised Board Bylaw 9250 and new Exhibit 9250, Remuneration, Reimbursement and Other Benefits.

Analysis:

It is the goal of the superintendent and staff to review the district’s board policies and administrative regulations on a regular basis and bring new and/or revised board policies and administrative regulations to the board of trustees for approval.

 

Per Board Bylaw 9250, the board members receive a monthly stipend, and they may increase that stipend on an annual basis, per Education Code Section 35120.  In January 2002, the board of trustees approved an increase in compensation of five percent (from $750 to $787.50), the maximum increase allowed per Education Code.  In December 2006, the board of trustees approved an increase in compensation equal to the increase provided to certificated and counseling personnel, subject to a cap of five percent (from $787.50 to $827).

 

Per Education Code 35120 and Board Bylaw 9250, if a board member does not attend all board meetings during the month, he/she is eligible to receive a percentage of the monthly stipend equal to the percentage of meetings attended.  When a board member is absent, they may be compensated for that meeting by resolution duly adopted by the board.

 

This bylaw is being revised to clarify when a board member may be paid for a meeting when absent.  An exhibit is also being recommended for approval, which is the form to request compensation for a missed meeting.  Only upon submission of the form to the clerk of the board will a board resolution be brought forward for the board’s consideration to approve the request for compensation.

 

This Board Agenda Item supports LCAP Goal 4, coherent and transparent systems, because it provides a definitive procedure and form for the board members to request compensation for a missed meeting.
